OF PEORIA COUNTY OF PEORIA AND STATE OF ILLINOIS
WHEREAS, a portion of the public alley, more particularly
hereinafter described, is no longer of value to the public; and
WHEREAS, in the opinion of the City Council of the City of
Peoria, the public interest will be subserved by vacating a portion
"of said alley, as hereinafter described;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PEORIA, ILLINOIS:
Section 1. That a portion of the alley described as follows,
to -wit:
That part of the public alley lying between Lots Eighteen
(18) and Nineteen (19) on the West and Lots One (1) and
Two ( 2 ) on the East, all in Block "B" in EDWARD BOHANAN I' S'
ADDITION to the City of Peoria, being sixty feet (60) in
length by thirty feet (30) in width and running south from
West Donald Street and parallel to and between North Bour-
land Avenue and North Machin Avenue, situated in the City
of Peoria, County of Peoria, Illinois;
be and the same is hereby vacated and closed, inasmuch as the same
is no longer required for public use and the public interest will be
subserved by such vacation.
Section 2. That the vacation herein provided for is made
upon the express condition and reservation, for the benefit of the
Central Illinois Light Company and Illinois Bell Telephone Company,
retaining and reserving for the Central Illinois Light Company and
Illinois Bell Telephone Company a.perpetual right-of-way over and
across, and an easement in, the portion of the alley herein de-
scribed, for the purpose of maintaining their utility plants, or
parts thereof, now located in said portion of said alley.
Section 3. That the vacation herein provided for is made
upon the express condition that within thirty (30) days after
passage of this ordinance, the owners of the abutting property

shall pay or cause to be paid to the City of Peoria the sum of
One Hundred Dollars ($100.00) as compensation for the benefits
which will accrue to them as owners of the property abutting said
portion of the alley hereby vacated, which sum, in the judgment of
this Body, will be equal to, such benefits.
Section 4. This ordinance shall take effect and be in force
from and after its passage, provided that within thirty (30) days
after the passage of this ordinance the owners of the adjoining
property shall file or cause to be filed for record in the office
of the Recorder of Deeds of Peoria County, Illinois, a certified
copy of this ordinance.
PASSED BY THE CITY COUNCIL OF THE CITY OF PEORIA, ILLINOIS,
this 7-7--day of A.D. 1958.
