A regular meeting of the y Council was held this date at 8: 0 o'clock presiding. Mayor Leiter p g. ROLL CALL Roll call showed the following members present: Boswell, Kennedy, Kumpf, Lay, Manning, Neumann, Mayor - 7. Councilman Lehnhausen arrived at his desk a few minutes late. INVOCATION Reverend Father Leo Bates, St. Patrick's Church MINUTES Councilman Kumpf moved that the minutes of the previous meeting stand approved as printed. There being no corrections or alterations, the Chair declared that the minutes of the previous meeting would stand approved as printed. 29, PARKING METER FEES (59-60) Communication from L.E.Throckmorton, dated January 1959: "In as much as your Traffic Engineer has submitted a proposal to jump the parking fee to 10e', I think you might like to know the reaction to the 20 minute parking during the Christmas Post Office rush. I had many customers who commented on the idea and fact that they could find a parking meter for a few minutes and not have to drive around the block to find a parking space and near a,desired place. It was a big help and a noticable increase in our business. I have had comment since Christmas, stating that they wished there was still a 20 minute parking. From this experience it seem to me that in place of in- creasing to a 10i meter it would be better to make a 5d thirty minute time. If a party wished to stay more than that time he could put in two nickles. This would equal a 10i meter and cost no more to the short time parker and also get a nickle from the second party in place of him getting a few minutes of free parking on the other fellows time. 3007 Council Proceedings By excavating Hamilton, Main or Fulton Street, forming an under pass to the City Parking lot and for an extra dime, shuttle park cars from entrance for the parties who do not want to walk that distance. In the case of rain, parties could walk back to place desired and not get wet. The entire block and down to a sub -basement, in the pro- posed new Court House is a good parking spot. It has been done in other Cities. Even now, by cutting down the wide, sidewalk around the court house, twice as many cars could be parked 5J Parkin Meters be retained (59-61) Communication from Morgan Baldridge, Hobbymodels, 418 S.W,Adams St., Peoria, Illinois dated Jan. 29, 1959, made the property of the Council by common consent, by order of the Chair, there being no objection. "The original installation of parking meters was sold to the people of Peoria and the business establishments as a park- ing regulation, in order to provide more parking spaces for more people. Was this propaganda? Can it be that the new proposal of the ten cent meter now puts this in its true light, and the earlier regulation was sold under false colors? We have no fault to find with the five cent meter and the excellent law enforcement that goes with it. We feel that it has kept traffic moving in and out of the parking spots available, although more than once, I have had a prospect leave the store, because his meter was almost run out. I have also happily paid the dollar fine, when said customer stayed to buy. I do feel that to raise this fee to ten cents would be a tragedy to the downtown shopping area who has already been hit crippling blows by the outside city limits stores with free and unlimited parking, and NO CITY SALES TAX. There seems to be and open season on the motorist, from the Federal government on down. Lets not kill this golden goose, but let him live to lay eggs than can benefit us all." Councilman Lehnhausen moved that both communications be referred to the City Manager and Traffic Engineer. Adopted by viva voce vote. ENGAGEMENT OF CERTIFIED PUBLIC ACCOUNTANT TO PERFORM THE ANNUAL AUDIT (59-62) Communication from P.G,BardezBanian, Acting Finance Director, dated January 26, 1959: 3008 Council Proceedings "The City Council in accordance with previous custom and as of 1951 in accordance with Illinois Municipal audit- ing law engages a certified public accountant to perform the annual audit. The 1959 budget privides $3000. for this service in the City Councils Other Contractual Services account. It would be desirable at this time for the City Council to appoint an auditor for the 1958 audit so that he may be notified accordingly. F.G.Bruninga & Co. has satisfactorily performed the audit since 1941. CONVEYANCE OF THE CITY PORTION OF TITLE TO CEDAR ST. BRIDGE TO THE STATE OF ILLINOIS filed. Communication and attachment (59-64) Communication from Max J.Lipkin, Corporation Counsel, dated January 29, 1959: "Submitted herewith is a letter from Mr.John D.Mattison, District Engineer, State of Illinois Division of Highways, submitting an Agreement to be entered into between the City of Peoria and the State of L.ilinois, and a form of Deed from the City of Peoria to the State of Illinois, which documents, when executed, will convey the title to the Cedar Street Bridge to the State of Illinois. 3009 Council Proceedings There is also submitted herewith a Resolution authoriz- ing the execution of said Deed and said Agreement. The Agreement provides, in substance, that if, in the future, the State is required to acquire any additional rights or easements in real estate in order to maintain and operate the said Cedar Street Bridge as now constructed, the City will indemnify the State for any cost or expense that it may incur in connection with such acquisition, and that the City will continue to discharge its obligations to maintain the streets under said bridge and in the vicinity thereof." Attachment Communication from John D.Mattison, District Engineer, State of Illinois, Department of Public Works and Buildings, Division of Highways, Reor_la, Illinois, dated January 29, 1959, addressed to Herbert D.Fritz, City Manager, and Max J.LIpkin, Corporation Counsel, City of Peoria: "We have, as you know, for sometime been considering the re- quest of the City of Peoria to transfer ownership of the City's portion'of the Cedar Street Bridge to the State .of Illinois. The form of conveyance and conditions under which such a transfer should be accomplished were discussed at a meeting in Mr.John Radley's office on January 23,1959, by representatives of the Division of Highways and Mr.Lipkin. As a result of that meeting I am submitting herewith, for consideration by the City of Peoria, the following proposed documents. 1. AGREEMENT BETWEEN THE CITY OF PEORIA AND THE DEPARTMENT OF PUBLIC WORKS AND BUILDINGS OF THE STATE OF ILLINOIS RELATIVE TO THE CEDAR STREET BRIDGE. 2. SPECIAL WARRANTY DEED. Please advise if any further Information is needed in your consideration of this matter. Councilman Lay moved that reading of the communication and attachment be dispensed with and that same be received and filed. Adopted by viva voce vote. DRIVING SURFACE - CEDAR ST.BRIDGE TO BE PROTECTED Councilman Manning moved that the City Manager be referred the matter of taking whatever steps are necessary to protect the driving:surface of the Cedar St. Bridge especially where reinforcing rods are protruding. Adopted by viva voce vote. 3009A Council Proceedings (59-65) "WHEREAS, the and owned, and now Street Bridge; and RESOLUTIONS Conveyance of City's Portion of Cedar St. Bridge to the State of Illinois City of Peoria has heretofore constructed owns, a certain bridge known as the Cedar WHEREAS, the City of Peoria has requested the State of Illinois to accept title to said bridge and maintain, repair and operate the same; and WHEREAS, the State of Illinois is willing to accept title to said bridge and bear all costs of the maintenance, repair and operation of the same, if it is assured that it will not be required to bear the cost of the acquisition of any rights or easements in real estate in order to assure the continued operation of such bridge; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEORIA, that the Mayor and City Clerk are hereby instructed and directed to execute a special Warranty Deed con- veying to the State of Illinois for the use of the Department of Public Works and Buildings, all of the right, title and interest of the City of Peoria in the premises and highway bridge known as the Cedar Street Bridge, as the same is now located, and all easements and rights thereunto appertaining; BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby instructed and directed to execute an Agreement be- tween the City of Peoria and the Department of Public Works and Buildings of the State of Illinois, relative to the Cedar Street Bridge, a copy of which Agreement is attached hereto ,and made a part hereof." Removalof vehicles from city streets (59-66) after snow fall "RESOLVED, That the Legal Department be and they are hereby instructed and directed to prepare an amendment to the Municipal Code of 1957, as amended, to provide that in all in- stances where there is a snow fall of more than two inches a state of emergency shall be deemed to exist and all vehicles parked on the streets of the city shall be removed at once by their owners until such time as the snow fall has been removed or the streets of the city made passable by mechanical equipment or other means." 3011 Council Proceedings Councilman Boswell moved that the resolution be referred to the City Manager, Director of Streets and Sewers, Corporation Counsel and Traffic Engineer for study and preparation of ordinance. ORDINANCES ADOPTED Ordinance No. 7156 Annexation of Lot 72 in Albert Fulton Subdivision AN ORDINANCE ANNEXING TO THE CITY OF PEORIA CERTAIN TERRI- TORY KNOWN AS LOT SEVENTY-TWO IN ALBERT FULTON SUBDIVISION; IN THE COUNTY OF PEORIA, ILLINOIS, was read by the Clerk. Councilman Kumpf moved that the ordinance be now placed upon its passage. Adopted by roll call vote: Yeas: Boswell, Kennedy, Kumpf, Lay, Lehnhausen, Manning, Neumann, Mayor - 8. Nays: None. The Chair then declared the ordinance adopted. Ordinance No. 7157 Vacating a portion of North Hayden Pioce .AN ORDINANCE VACATING A PORTION OF NORTH IiAY!EN PLACE IN THE CITY OF PEORIA, ILLINOIS, was read by the Clerk. The Chair then declared the ordinance adopted. FINANCIAL STATEMENT (59-67) City of Peoria Financial Statement for period Janu- ary 1, 1958 to December 31, 1958 as prepared by the City Comptroller. There being no objection, same was received and filed by common consent, by order of the Chair. EMERGENCY AP1 ROPRIATION City Manager Herbert D.Fritz adVisati the Council that the 1959 Appropriation Ordinance being preparet by the Corporation Counsel will carry an emergency appropriation item fot snow removal. 3012 Council Proceed4nfos PROCLAMATIONS Lincoln Sesquicentennial Month and Week (59-68) Proclamation by Mayor Leiter proclaiming the month of February as Lincoln Sesquicentennial Month and further proclaiming and declaring the period of February 6 through 13,1959, as Lincoln Sesquicentennial Week, was read for information purposes. Feb. 12,1959, NAACP Golden Anniversary Day (59-69) Proclamation by Mayor Leiter proclaiming the twelfth day of February,1959, NAACP Golden Anniversary Day and urging the citizens of Peoria to observe the 50th anniversary of the -founding of the National Association for the Advancement of Colored People through support of the ideals of the Association and participating in activities celebrating the event throughout the year 1959, was read for information purposes. APPRECIATION (59-70) Communication from Arthur J.Holst to Bernard J. Kennedy, Chief of Police, dated January 29, 1959: "A note of appreciation to the entire Police Force for the good job you did during the terrific snow storm. I have only lived in Peoria two years, but I have developed a deep respect for our Police Force and for the very able direction which you give it. My sincere thanks and appreciation for a job well done." (59-71) Communication to Leonard H.Caro, Director of Streets and Sewers, from Arthur J.Holst, dated January 29, 1959: "Just a note of appreciation to you for the wonderful job you and:your employees did in removing the snow from the city streets this past week. You had the snow off the many miles of streets before I had it off my few feet of driveway." WALKER SAFETY AWARD - TRAFFIC SAFETY (59-72) Communication from Frank J.Schira„ President, National Police Officers Association, to Mayor Leiter, dated January 28, 1959; made the property of the Council by common consent, there being no objection: "During the past year we have made a study of the prog- ress of your city in reducing traffic fatalities and injuries during 1958. Our records indicate that an outstanding record was achieved during this period. Based upon this record we have cited your police department with the annual WALKER SAFETY AWARD certificate which is enclosed. 3013 Council Proceedings This award commends the members of your police department in their enforcement of traffic regulations in your community. This is a very difficult job at best but the results are the saving of human lives and loss of property. Because this work goes by without recognition we have instituted this program now in its second year. We would appreciate you, on our behalf, presenting this Award to the Chief of Police of your community with our con- gratulations to all the members of his enforcement team. We hope that next year at this time w.e will be sending your your second or third award for traffic safety. This announcement has been made to the newapap r and radio people in your area and no doubt that they will cohtact you for a picture or story. This is an ideal time for obtaining favor- able publicity for your police department and we urge you to do so. Again, our best wishes and congratulations for eking your city a safer place to work, live, and play." Mayor Leiter presented the safety award certificate to.Supt. of Police. Bernard J.Kennedy. REQUEST THAT NORTH END STREET LIGHTING BE IMPROVED (59-73) Communication from R.J.Paluska, President, North Side Business Men's Ass'n., dated January 29, 1959, which reads in part: "During the January meeting of the North Side Business Men's Assn. a motion was made that the city be contacted to determine if any thought had been given to improving the street lighting in the north end. It is felt that the lighting, particularly on North Adams Street, is out-moded, inadequate, and sub -standard in comparison to other equally used streets, in the city. It is also felt that the in -sufficient lighting could be con- tributing to the frequent burglarism on North Adams Street. We would very much appreciate your views on this matter at your earliest convenience." Councilman Lay moved that the communication be referred to the City Manager. Adopted by viva voce vote. Council Proceedings CHAIRMAN OF LINCOLN SESQUICENTENNIAL COMMITTEE INTRODUCED 3014 Mayor Leiter introduced Professor Louis A.R.Yates of Bradley University, Chairman of the Lincoln Sesquicentennial Committee, and thanked him and the other members of the committee for the work done by said committee. NEW CITY PURCHASING AGENT At the suggestion of City Manager Herbert D.Fritz, Peter G. BardezBanian, Acting Comptroller of the City introduced Paul J.Astel who commenced his duties as Purchasing Agent on Monday, February 2, 1959.
