HomeMy WebLinkAbout1999-05-11 14,729 Approve Designation of Springdale CemeteryORDINANCE NO. 14,729 AN ORDINANCE APPROVING THE DESIGNATION OF SPRINGDALE CEMETERY LOCATED AT 3014 N PROSPECT ROAD AS A LOCAL HISTORIC LANDMARK PURSUANT TO CHAPTER 16 OF THE PEORIA CITY CODE (ORDINANCE NO. 11,990 ADOPTED AUGUST 15, 1989) WHEREAS, the City Council, on August 15, 1989, adopted Ordinance No. 11,990, entitled "An Ordinance providing for the Creation of Historic Preservation Districts, Historic Landmarks and a Historic Preservation Commission" (formerly Appendix I of the Peoria Code, now Chapter 16); and WHEREAS, said Ordinance sets forth a procedure for the nomination and designation for the property located at 3014 N Prospect Road pursuant to said Ordinance; and WHEREAS, the Historic Preservation Commission, at a regular meeting, considered said application and determined to conduct a public hearing concerning said application; and WHEREAS, after proper notice in accordance with said Ordinance, said Commission conducted a public hearing on April 21, 1999 to consider the application for designation of said property to be a local historic landmark and submitted its recommendation to the City Council; and WHEREAS, following said public hearing, the Commission determined to recommend granting said designation as a local historic landmark; and WHEREAS, The City Council hereby finds that the above described property is worthy of Local Landmark Status in accordance with Chapter 16 of the Code of the City of Peoria (City of Peoria Historic Preservation Ordinance) because of: A. Its character, interest of value as part of the development, heritage or cultural characteristics of the city, the county, the state or the United States of America; B. Its identification with a person who significantly contributed to the development of the city, the state or the nation; C. Its embodiment of distinguishing characteristics of an architectural style valuable for the study of a period, type, method of construction or use of indigenous materials; ORDINANCE NO. 14,729 D. Its embodiment of elements of design, detailing, materials or craftsmanship that render it architecturally significant; E. Its embodiment of design elements that make it structurally or architecturally innovative; and F. Its unique location or singular physical characteristics that make it an established or familiar visual feature. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEORIA, ILLINOIS AS FOLLOWS: Section 1. The property located at 3014 N Prospect Road more particularly described as follows (see Attachment A); is hereby designated as a local historic landmark pursuant to Ordinance No. 11,990 adopted August 15, 1989. Section 2. This Ordinance shall be in full force and effect from and after its passage and approval according to law. APPROVED: Mayor ATTEST: City EXAMINED AND APPROkc_ Corporation Counsel ORDINANCE NO. 14,729 ATTACHMENT A LEGAL DESCRIPTION Part of the Northwest Quarter of Section 34 and part of the Northeast Quarter of Section 34 and part of the Northwest Quarter of Section 35 and part of the Southeast Quarter of Section 27, all in Township 9 North, Range 8 East of the Fourth Principal Meridian, more particularly bounded and described as follows, to -wit: Commencing at the common corner of Sections 26, 27, 34 and 35 in Township 9 North, Range 8 East of the Fourth Principal Meridian, for the Point of Beginning of the property to be described; thence North along the East line of the Southeast Quarter of Section 27, a distance of 1594 feet to a point; thence West and parallel to the South line of said Section 27, a distance of 1302.75 feet to a point; thence South and parallel to the East line of Section 27 a distance of 1594 feet to a point on the Sout line of said Section 27, also being a point on the North line of Section 34; thence West along the North line of said Section 34 to a point at the Northwest corner of the Northeast Quarter of said Section 34, also being a point on the middle of Prospect Road (formerly Mount Hawley Road); thence Southwesterly along the middle of said Prospect Road to a point which is 424 feet West of a point 1320 feet South from said Northwest corner of the Northeast Quarter of Section 34; thence East 424 feet to a point on the West line of the Northeast Quarter of Section 34; thence South along said West line to a point which is 627 feet, more or less, North of the center of Section 34 (said point also being on the South line of Gift Avenue Extended); thence East and parallel with the South line of Section 34 a distance of 434 feet; thence Southeasterly a distance of 771.77 feet, more or less, to a point on the South line of Section 34 said point is being 884 feet East of the center of Section 34; thence East along the South line of the Northeast Quarter of Section 34 to the Southeast corner of the Northeast Quarter of said Section 34; thence North on the East line of the Northeast Quarter of said Section 34 (being also the West line of the Northwest Quarter of Section 35) to a point which is 329.5 feet North of the Southwest corner of the Northwest Quarter of Section 35; thence East 120 feet to a point on the Westerly railway line of the Chicago, Rock Island and Peoria Railroad; thence Northeasterly along the Westerly railway line of said Chicago, Rock Island and Peoria Railroad to a point which is 880.11 feet South of the North line of Section 34, said point also being East of the West line of Section 35 a distance of 771.21 feet; thence North and parallel with the West line of said Northwest Quarter of Section 35, a distance of 880.11 feet to a point on the North line of Section 35; thence West along the North line of Section 35 a distance of 771.21 feet to the Point of Beginning. EXCEPT (or subject to) the following rights -of -way: (1) The East Half of Prospect Road (formerly Mount HawleyRoad) in the Northeast Quarter and Northwest Quarter of Section 34; (2) The Chicago, Rock Island & Peoria Railroad right-of-way in the Southeast corner of the Northeast Quarter of Section 34; (3) The War Memorial Drive right-of-way in the Southeast Quarter of Section 27; (4) The South One -Half of Wilson Avenue from the East line of Grand Avenue to the West line of War Memorial Drive in the Southeast Quarter of Section 27.
